Welcome to Machinery Quotes. By accessing or using this website, you agree to be bound by these Terms of Use. If you do not agree with these terms, please stop using the website.

In these terms, “we”, “our”, or “us” refer to Avtext Pty Ltd trading as Machinery Quotes (ABN 88 116 839 037). “You” refers to any person who accesses or uses the website, whether as a buyer, a seller, a dealer, or a visitor.

1. Acceptance of terms

By using this website you acknowledge that you have read, understood, and agreed to these Terms of Use and to our Privacy Policy. If you use the website on behalf of a business, you confirm you are authorised to accept these terms for that business.

We may update these terms from time to time. Where a change materially affects your rights, we will give you reasonable notice before it takes effect, and your continued use of the website after that date means you accept the updated terms. If you do not accept a change, you may stop using the website and, if you hold a paid subscription, cancel it in accordance with section 8.

2. What Machinery Quotes is, and is not

Machinery Quotes is an online marketplace and lead-generation service. We provide a platform where sellers can list used construction and agricultural equipment, and where buyers can find those listings and make enquiries.

You agree and understand that:

  • We are not a party to any sale, purchase, or other transaction between a buyer and a seller.
  • We are not a dealer, seller, agent, broker, auctioneer, or valuer, and we do not act for either the buyer or the seller in any transaction.
  • We do not own, take possession of, inspect, test, verify, or take custody of any machine listed on the website.
  • We do not verify the accuracy of any listing, the condition, hours, history, title, or ownership of any machine, or the identity, character, or solvency of any buyer or seller.
  • Any contact, negotiation, sale, payment, and delivery happens directly between the buyer and the seller, off our platform and at their own risk.

Buyers and sellers are solely responsible for satisfying themselves about the other party and about any machine before entering into any transaction, including by carrying out their own inspection, verification of title and finance owing, and any safety or compliance checks.

3. Accounts

To list a machine or manage enquiries you may need to create an account. You are responsible for keeping your login details confidential and for all activity under your account. You must give us accurate and current information and keep it up to date. We may suspend or close an account that breaches these terms or that we reasonably believe poses a risk to other users or to us.

4. Listings and seller content

If you post a listing, photos, or any other content (“your content”), you agree that:

  • You own the machine you are listing, or you are authorised by the owner to list it and to sell it.
  • Your content is accurate, current, and not misleading, including the description, condition, hours, location, and price.
  • You will not list anything you are not legally entitled to sell, that is stolen, subject to undisclosed finance you cannot discharge on sale, or that infringes anyone’s rights.
  • Your content does not breach any law, infringe any intellectual property or other rights, and is not defamatory, offensive, or deceptive.

You grant us a non-exclusive, royalty-free licence to host, store, reproduce, adapt, publish, and display your content on the website and in our marketing of the website and of your listing (including in online advertising such as social media lead ads), for as long as your listing is active and for a reasonable period afterwards for record-keeping. You can ask us to remove a listing at any time.

We may review, edit, decline, or remove any listing or content at any time, with or without notice, including where we reasonably believe it breaches these terms or a law. We are not obliged to monitor content, and we are not responsible for content posted by users.

5. Enquiries and leads

When a buyer makes an enquiry, we may pass that enquiry, and the buyer’s contact details, to the relevant seller or dealer so they can respond directly. By making an enquiry you consent to your details being shared with that seller or dealer for that purpose.

We do not guarantee, and make no representation about:

  • the number, quality, accuracy, or genuineness of any enquiry or lead;
  • that any enquiry will result in a sale, a quote, contact, or any other outcome; or
  • the conduct of any seller, dealer, or buyer who receives or responds to an enquiry.

Once we have passed an enquiry on, the communication and any resulting dealing are between the buyer and the seller or dealer, and we are not responsible for it.

6. No guarantee about machines, users, or outcomes

To the maximum extent permitted by law, we do not guarantee anything about the machines, users, listings, enquiries, or transactions on the website. You use the website, and rely on any listing or enquiry, at your own risk. This section does not limit the consumer guarantees that apply to our own paid services under section 11.

Safety and inspection are your responsibility. We do not inspect, test, service, certify, grade, or verify any machine, and we make no representation that any machine is safe, roadworthy, compliant with any law or standard, free of defects, or fit for any purpose. Before buying, using, transporting, or operating any machine, you are responsible for having it independently inspected and tested, for confirming it is safe and complies with all applicable workplace, safety, and roadworthiness requirements, and for ensuring anyone who operates it is properly licensed and trained.

We strongly recommend that, before you pay any money or enter into any agreement, you (or a qualified person on your behalf) physically inspect and test the machine, confirm its identity, hours, and service history, and check that it is free of any money owing. Do not rely on photos, descriptions, or anything on the website in place of your own inspection.

We are not in the supply chain. We are not a manufacturer, importer, supplier, or seller of any machine listed on the website, and we are not part of the supply chain for any machine. Responsibility for the condition, safety, and compliance of a machine rests with the seller and the buyer, not with us.

7. Prohibited conduct

You must not:

  • use the website for any unlawful, fraudulent, or misleading purpose;
  • post a fake, inaccurate, or misleading listing, or misrepresent a machine or yourself;
  • harvest, scrape, copy, or extract data or content from the website by automated means, or reproduce or resell any part of the website or its content;
  • attempt to bypass, disable, or interfere with the website, its security, or its fee arrangements, including by taking a transaction off-platform to avoid fees where a fee would otherwise apply;
  • collect or misuse other users’ personal information, or contact them for any purpose other than the genuine enquiry or sale; or
  • upload harmful code or attempt to gain unauthorised access to the website or its systems.

8. Fees, subscriptions, and payment

Some services on the website are paid, including dealer subscriptions and paid private listings. All prices are in Australian dollars and inclusive of GST. The current fee for each paid service is shown on the website before you commit, and we will issue a tax invoice for each payment.

  • Dealer subscription. A dealer subscription is a recurring subscription, currently $199 per month.
  • Private listing. A paid private listing is a one-off fee, currently $49, charged when you publish the listing.
  • Prices may change. Our fees are current at the date shown but may change over time. For a one-off listing, the price that applies is the price shown when you publish. For a subscription, we will give you reasonable notice before a fee change takes effect, and you may cancel before it applies if you do not accept it.
  • Billing. Paid services are charged to the payment method you provide through our payment processor (Stripe). By providing a payment method you authorise us to charge the applicable fees to it as they fall due.
  • Auto-renewal. A dealer subscription renews automatically each month, and we will charge your payment method for each monthly renewal until you cancel. Before you subscribe, we show you the renewal amount, that it recurs monthly, and how to cancel. You can cancel at any time to stop the next renewal (see section 9).

9. Cancellation and refunds

  • You may cancel a dealer subscription at any time. Cancellation stops the next renewal. Your access continues until the end of the period you have already paid for, and we do not refund the balance of a current paid month unless the law requires it.
  • A paid private listing fee is for a service we perform when your listing goes live, so it is not refundable once the listing is published, unless the law requires it.
  • Nothing in this section limits your rights under the Australian Consumer Law (see section 11).

10. MQ AI and information on the website

The website may include an AI feature (“MQ AI”) and other general information. MQ AI answers questions using publicly available manufacturer (OEM) brochures and specifications, and links to those brochures and to the manufacturers’ own websites. Those brochures and websites belong to their respective owners, and we link to them for convenience only.

Information provided by MQ AI and elsewhere on the website is general information only. It may be incomplete, out of date, or inaccurate, and it does not state what any machine is worth. Nothing on the website is financial, legal, valuation, or professional advice, and you should not rely on it as such. You should confirm any specification directly with the manufacturer and seek your own independent advice before acting.

11. Consumer guarantees and limitation of liability

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, that the law says cannot be excluded or limited.

To the maximum extent permitted by law, and subject to those non-excludable rights:

  • our services and the website are provided “as is” and “as available”, and we do not warrant that they will be uninterrupted, error-free, or that any listing or information is accurate;
  • we exclude all liability for any loss or damage (including indirect or consequential loss, loss of profit, loss of opportunity, any personal injury, death, or property damage arising from a machine, and any loss arising from any dealing between users) arising from your use of, or reliance on, the website; and
  • where we are liable for a failure to comply with a consumer guarantee that cannot be excluded, and the failure does not relate to goods of a kind ordinarily acquired for personal use, our liability is limited, at our option, to supplying the service again or paying the cost of having it supplied again.

12. Finance referrals

We may tell you about finance options available through our finance partner, Valiant Finance. If you ask us to, we will pass your name and contact details to Valiant so they can contact you about finance. That is all we do. We do not give you credit assistance or advice, we do not recommend, arrange, or help you apply for any particular loan, and we are not the credit provider.

Any finance or credit service is provided by Valiant Finance under their own terms and privacy policy, and whether you deal with them is your decision. We may receive a benefit, such as a referral fee or commission, if you take up finance after we refer you, and we disclose this to you before you ask us to pass on your details.

13. Marketing communications

Where you have given us your consent, we may contact you by email and SMS for marketing purposes. We only send marketing to people who have opted in, and we keep a record of that consent. Every marketing message identifies us as the sender and includes a free, working way to unsubscribe. You can opt out at any time, by using the unsubscribe link in an email or replying STOP to an SMS, and we will action your request promptly. Opting out of marketing will not stop service or transactional messages relating to a listing or enquiry you have made.

14. Privacy

We handle personal information in accordance with our Privacy Policy, which forms part of your use of the website. By using the website you agree to the collection and handling of your information as set out in that policy.

15. Intellectual property

The website, and all content we provide (including text, branding, graphics, layout, and design), is owned by or licensed to us. You must not copy, reproduce, modify, distribute, or extract any part of it without our written permission. Content posted by users remains theirs, subject to the licence they grant us in section 4. Manufacturer brochures and specifications belong to their respective owners.

The website may link to external websites, including manufacturer websites and our finance partner. These links are provided for convenience only. We do not control those sites and take no responsibility for their content or practices.

17. Indemnity

To the maximum extent permitted by law, you indemnify us against any claim, loss, liability, or cost (including legal costs) we suffer or incur arising from your content, your use of the website, your dealings with another user, any machine you list, buy, sell, or operate, any injury, death, or property damage connected with a machine or a transaction, or your breach of these terms or of any law. If you are a seller, this includes any claim brought by a buyer or any other person in connection with a machine you have listed or sold.

18. Suspension and termination

We may suspend or close your account, or remove your content, at any time if you breach these terms, if we are required to by law, or if we reasonably believe your use poses a risk to other users or to us. You may stop using the website, and cancel any subscription under section 8, at any time. Sections that by their nature should survive (including sections 6, 11, 15, and 17) continue after your use ends.

19. General

  • Governing law. These terms are governed by the laws of New South Wales, Australia, and you submit to the courts of New South Wales.
  • Severability. If any part of these terms is found to be invalid or unenforceable, the rest continues to apply.
  • Assignment. You may not transfer your rights under these terms without our consent. We may assign or transfer our rights, for example if our business is sold.
  • Waiver. If we do not enforce a right, that is not a waiver of it.
  • Entire agreement. These terms, together with our Privacy Policy, are the entire agreement between you and us about your use of the website.
