Machinery Quotes, Privacy Policy
Privacy collection statement (short version)
This statement is a quick summary. The full policy is below.
Machinery Quotes (Avtext Pty Ltd, ABN 88 116 839 037) collects personal information such as your name, email address, and mobile number when you list a machine, make an enquiry, create an account, or contact us. We use it to run the marketplace, to connect buyers with sellers, to provide our paid services, and, where you have agreed, to send you marketing. We share enquiry details with the relevant seller or dealer so they can respond to you, and we use trusted service providers (for hosting, payments, and email and SMS) to operate the website. Some of those providers may store data overseas. You can access or correct your information, opt out of marketing, or make a complaint by contacting us at admin@machineryquotes.com. The full policy explains all of this in detail.
1. About this policy
This Privacy Policy explains how Avtext Pty Ltd trading as Machinery Quotes (“we”, “our”, “us”) handles your personal information. It applies to the Machinery Quotes website and services. By using the website you agree to your personal information being handled as described in this policy. This policy forms part of our Terms of Use.
We are bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles, and we handle your personal information in accordance with them.
2. What is personal information?
Personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether true or not and whether recorded in a material form or not. Examples include your name, contact details, and account information.
3. What personal information we collect
Depending on how you use the website, we may collect:
- Contact and identity information, such as your name, email address, mobile or phone number, and the location of a machine you are listing.
- Account information, such as your login details and settings.
- Listing information, such as the details and photos of a machine you list, and its asking price.
- Enquiry information, such as the message and details you provide when you enquire about a machine or request finance.
- Payment information, when you buy a paid service. Payments are processed by our third-party payment provider, and we do not store your full card details ourselves.
- Communications, such as your emails, live chat, and messages with us.
- Technical and usage information, such as your device and browser information, IP address, a device or browser identifier, and how you use the website (see section 9).
You do not have to give us your personal information, but if you do not, we may not be able to provide the service you are asking for, such as listing a machine or passing your enquiry to a seller.
4. How we collect personal information
We collect personal information:
- Directly from you, when you create an account, list a machine, make an enquiry, buy a paid service, subscribe to marketing, or contact us.
- Automatically, when you use the website, through cookies and similar technologies (see section 9).
- From third parties, such as when you submit an enquiry through a form on one of our advertisements on third-party advertising platforms, which then provide that information to us.
5. Why we collect and use your personal information
We collect and use your personal information to:
- operate the marketplace and your account;
- publish your listing and connect buyers with sellers and dealers;
- pass your enquiry, and your contact details, to the relevant seller or dealer so they can respond to you;
- provide and bill for our paid services;
- respond to your questions and provide support;
- where you have agreed, send you marketing about machines, dealers, and our services;
- where you ask us to, refer you to our finance partner (see section 6);
- protect the website, enforce fair-use limits on free features, and detect and prevent fraud and abuse; and
- meet our legal obligations.
6. When we share your personal information
We share personal information in the following ways:
- With sellers and dealers. When you enquire about a machine, we share your enquiry and contact details with the relevant seller or dealer so they can respond to you directly. After that, your dealings are between you and them.
- With our service providers. We use trusted third-party providers to operate the website, including for hosting, data storage, payment processing, and email and SMS delivery. They may only use your information to provide their service to us.
- With our finance partner. If you ask us to, we share your name and contact details with our finance partner (Valiant Finance) so they can contact you about finance. We may receive a benefit if you take up finance after we refer you. We are not the credit provider and do not give credit advice.
- Where required or permitted by law, such as to a regulator, law enforcement, or to protect our rights or the safety of others.
- If our business is sold or transferred, to the new owner, subject to this policy.
We do not sell your personal information.
7. Is your information disclosed overseas?
Some of the third-party tools we use to operate the website store or process personal information outside Australia, including in the United States and Singapore. Where we disclose personal information overseas, we take reasonable steps to ensure the recipient handles it consistently with the Australian Privacy Principles, for example through our contracts with them.
8. Marketing and how to opt out
Where you have given us your consent, we may send you marketing by email and SMS. Every marketing message identifies us as the sender and includes a free and easy way to unsubscribe. You can opt out at any time by using the unsubscribe link in an email, or by replying STOP to an SMS, and we will action your request promptly. Opting out of marketing will not stop service or transactional messages relating to a listing or enquiry you have made.
9. Cookies, device recognition, and tracking
We and our providers use cookies and similar technologies when you use the website to:
- keep you logged in and remember your settings;
- understand how the website is used so we can improve it; and
- create an anonymous device or browser identifier that helps us enforce fair-use limits on our free features and detect and prevent abuse and fraud. This identifier is used to recognise a device, not to identify you personally.
We may also use third-party analytics and advertising platforms and tools to measure and improve our advertising.
You can control cookies through your browser settings. If you block some cookies, parts of the website may not work properly.
10. How we store and protect your information
We take reasonable steps to protect your personal information from misuse, loss, and unauthorised access, including access controls that limit who can see it, and using reputable providers for hosting and payments. No system is completely secure, so we cannot guarantee absolute security, but we work to protect your information and to respond quickly if an issue arises.
If a data breach occurs that is likely to result in serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner (OAIC) as required by the Notifiable Data Breaches scheme.
11. Accessing and correcting your information
You can ask us for a copy of the personal information we hold about you, and ask us to correct it if it is wrong or out of date. Contact us using the details in section 14. We will respond within a reasonable time. There is no fee to ask, though we may charge a reasonable cost for giving access in some cases. If we cannot give you access, we will tell you why.
12. Dealing with us anonymously
You can browse the website without telling us who you are. However, to list a machine, make an enquiry, hold an account, or buy a paid service, we need your personal information, so anonymous or pseudonymous dealing is not practicable for those.
13. Complaints
If you think we have mishandled your personal information, please contact us using the details in section 14 and we will look into it and respond. If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner at www.oaic.gov.au.
